This is to notify the general public of the Mooreland Board of Education’s plans to lease property owned by Mooreland Public Schools at the Northwest corner of South Elm St. and SH 412 also known as SW 6th St. Coordinate location description: 36°26’07.3″N 99°12’20.8″ W. This property is located directly North of the old high school and West of Jiffy Trip. The property will be leased for a period of 1 calendar year, beginning February 1, 2026, and the lease will go to the highest bid received. NOTICE OF SPECIAL ELECTION AND
SPECIAL ELECTION PROCLAMATION
Pursuant to the provisions of Title 68, Oklahoma Statutes 2021, as amended, Section 1370-1372, inclusive and pursuant to a Resolution of the Board of County Commissioners of Woodward County, Oklahoma, authorizing the calling of a special election for the purposes hereinafter set forth, I, the undersigned Chairman of the Board of County Commissioners of Woodward County, Oklahoma, hereby call a special election to be held on February 10, 2026, within said County, for the purpose of submitting to the qualified electors of Woodward County, Oklahoma, for their approval or rejection of the following proposition:
PROPOSITION
Shall a proposition of Woodward County, Oklahoma, making permanent, with no tax increase, one-tenth (1/10) of one (1) percent of the existing County sales tax for general government purposes, including, but not limited to, jail operations and maintenance, courthouse operations, public safety, and all other lawful functions for the benefit of the County; and extending three-tenths (3/10) of one (1) percent of the existing sales tax for a period of fifteen (15) years, with no tax increase, for qualified economic development and community facilities purposes including, but not limited to, matching funds for state and federal grants, electrical, water and sewer upgrades, road and bridge improvements, fire and EMS service support, promotion, retention, and expansion of business and industry, and all other projects that promote economic growth for the benefit of the County; providing for all revenues to be administered by the Board of County Commissioners and subject to annual budgeting, audit, and public reporting, as authorized by Title 68 O.S. §1370; and authorizing the pledging of sales tax revenues for the payment of principal and interest on any indebtedness incurred by or on behalf of the County, if applicable, be approved?
The ballot used at said election shall set out each proposition as above set forth, and shall also contain the words:

The polls shall be opened at 7:00 a.m. and remain open continuously and be closed at 7:00 p.m. on the day of the election.

AUTHORIZING SPECIAL ELECTION
PURSUANT TO THE LEGAL NOTICE AS IS REQUIRED BY THE OKLAHOMA OPEN MEETING ACT INCLUDING THE POSTING OF NOTICE AND AGENDA, THE BOARD OF COUNTY COMMISSIONERS OF WOODWARD COUNTY, STATE OF OKLAHOMA, MET IN REGULAR SESSION AT THE WOODWARD COUNTY COURTHOUSE BOARDROOM, 1600 MAIN STREET, WOODWARD, OKLAHOMA, AT 10:00 A.M. ON DECEMBER 8, 2025.

WHEREAS, the qualified voters of Woodward County, Oklahoma (the “County”) approved a levy of a one-half (1/2) of one (1) percent County Sales Tax, with one-tenth (1/10) of one (1) percent to be permanent and the remaining four-tenths (4/10) of one (1) percent to expire after thirteen years, and;
WHEREAS, the qualified voters of the County approved extending the expiring four-tenths (4/10) of one (1) percent levy until October 1, 2026, and;
WHEREAS, it is deemed necessary and advisable by the County Commissioners to promote the safety, security, and the general wellbeing of the people of Woodward County, to make provisions for economic and community programs for the benefit and the growth of the County; and
WHEREAS, there are no funds in the treasury for such purpose and power is granted to said Woodward County pursuant to authority of Title 68, Oklahoma Statutes 2021, Sections 1370-1372, as amended, inclusive, to levy and collect such tax to provide funds for such purpose providing the same be authorized by a majority of the registered, qualified electors of Woodward County, Oklahoma, voting at an election duly held for such purposes, and;
WHEREAS, the four-tenths (4/10) percent of one (1) percent sales tax set to expire on October 1, 2026, may be extended by the County’s qualified voters to provide funds for economic and community facility purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF WOODWARD COUNTY, STATE OF OKLAHOMA:
SECTION 1: PROPOSITION LANGUAGE. That the Chair of the County Commissioners be and is hereby authorized and directed to call for a special election to be held in Woodward County on February 10, 2026, whereupon the following Proposition shall be submitted to the qualified electors of the County for their approval or rejection:

SECTION 2: CONDUCT OF ELECTION. Only the registered, qualified voters of Woodward County, Oklahoma, may vote upon the Proposition as above set forth. The polls shall be opened at 7:00 AM and shall remain open continuously and be closed at 7:00 PM. The number and location of the polling places for said election shall be the same as the regular precinct polling places as designated for statewide and county elections by the Woodward County Election Board. Such election shall be conducted by those officers designated by the Woodward County Election Board, which officers shall also act as counters and certify the election results as required by law.
SECTION 3: DELIVERY OF RESOLUTION TO ELECTION BOARD AND DISTRICT ATTORNEY: The County Clerk or Deputy County Clerk of Woodward County is hereby direct to transmit a copy of this Resolution to the Secretary of the Woodward County Election Board and the District Attorney for Woodward County immediately upon approval hereof by the County Commissioners.
SECTION 4: PUBLICATION OF NOTICE. The publication of a Special Election Proclamation and Notice of even date herewith for at least four (4) weeks in a legal newspaper of Woodward County, Oklahoma, as required by Title 19, Oklahoma Statutes 2021, Section 383, is hereby authorized and directed.
SECTION 5: LEVY. Subject to approval of a majority of the registered voters of Woodward County voting thereon as herein provided, the existing one-half (1/2) cent Woodward County sales tax upon the gross proceeds or gross receipts derived from all sales or services in Woodward County upon which a consumers’ sales taxes levied by the State of Oklahoma shall be levied, in addition to all other taxes in effect in Woodward County, Oklahoma, for the purpose set forth herein. All items that are exempt from Oklahoma state sales taxes are hereby specifically exempted from the County sales tax. Such sales taxes due hereunder shall be and always constitute a prior, superior, and paramount claim as against the claims of unsecured creditors and may be collected by suit as any other debt.
SECTION 6: EFFECTIVE DATE. Should the proposition be approved, the extended three tenths (3/10) of one percent sales tax and use tax shall be effective October 1, 2026, and continuing thereafter until September 30, 2041, unless further extended by the voters of the County. Should the proposition be approved the one-tenth (1/10) of one (1) percent sales and use tax shall be made permanent effective October 1, 2026.
SECTION 7: PERMITTING. All valid and subsisting permits to do business issued by the Oklahoma Tax Commission pursuant to the Oklahoma Sales Tax Code are, for the purposes of this Resolution, hereby ratified, confirmed, and adopted in lieu of any requirement for an additional County permit for the same purpose.
SECTION 8: PURPOSE OF TAX. It is hereby declared that the purpose of this Resolution is to provide revenue for the purpose of funding capital improvements for Woodward County, and/or to be applied or pledged toward the payment of principal and interest on any indebtedness, including refunding indebtedness, incurred by or on behalf of Woodward County for such purpose. Economic Development and Community Purposes shall mean all purposes provided in Title 62 Oklahoma Statutes 2021, Section 802 (5), including, but not limited to, industrial facilities, training facilities, sports facilities, agricultural facilities, defense industry facilities, redevelopment programs, governmental facilities, community facilities, public infrastructure facilities, economic development programs, and public health facilities. The County Commissioners are hereby expressly authorized to pledge anticipated revenues generated by the sales tax for debt services payments, and other such authorized services.
SECTION 9: ESTABLISHMENT OF COMMUNITY ADVISORY BOARD. There is hereby established a County Area Projects Citizens Advisory Board (the “Board”). The Board shall review and make recommendations to the County Commissioners assigned tax funded projects. The Board shall consist of seven (7) members. All members shall be residents of the County at the time of their appointment and throughout their term. One member shall be a member of the Board of County Commissioners. Each County Commissioner shall nominate two (2) members who are residents of their respective Districts. All nominations shall be subject to confirmation and removal by the Board of County Commissioners. Board Members, except the County Commissioner Member, shall be appointed for a term of three years. Terms shall be staggered for 3 years as follows: two members with an initial term of one year, two members with an initial term of two years, and two members with an initial term of three years. Vacancies shall be filled for the remaining unexpired term of the vacating member. The Commissioner Member shall serve as Chair. The Board will designate a Vice-Chair annually by majority vote to serve a one-year term.
SECTION 10: DUTIES OF THE BOARD. The Board’s Duties shall be to advise the County Commissioners regarding projects proposed for funding from the sales tax proposed to the qualified voters on February 10, 2026, as detailed in a Resolution of Intent to be adopted by the County Commissioners, except for any investment of funds or expenditures for maintenance and operations of Economic Development and Community Facilities existing as of February 10, 2026.
SECTION 11: RESOLUTION OF INTENT. The County Commissioners shall pass a Resolution of Intent detailing the intended allocations of anticipated revenues. The County Commissioners anticipate that in certain years the principal of any revenues may be managed in such a manner that they remain individualized and only investment proceeds be expected.
SECTION 12: EMERGENCY. That by reason of there being no funds in the treasury for the purposes of the tax, and in order to promote the safety, security, and general well-being of the people of Woodward County, it is deemed and hereby declared necessary that said elation be held without delay, and to that end this Resolution shall become operative immediately, an emergency is hereby declared to exist whereby this Resolution shall be in full force and effect immediately from and after its passage and approval.
